McKenzie friends provide practical legal support and assistance to anyone who is representing themselves in court. This is known a LIP – litigant in person. They are however not Solicitors or allowed to speak directly on behalf of the person but they can help prepare documents, take notes, and offer advice during and after proceedings. This form of support can be from a family member, a volunteer, or a paid professional, but the court must usually give permission for them to be there.
What they can do
- Help write and draft statements
- Attend court hearings with you and provide support and assistance
- Take notes during court hearings
- Help organize case papers such as legal documents and bundles
- Quietly give advice on procedure or points of law
- Help prepare for the case
What they exempt from doing
- Signing legal documents for you
- Provide legal advice (beyond quiet guidance)
- Represent you in court or directly speak to the Judge unless permission is given
- Manage your case outside of court
Key things to remember
Cost: They can be a more affordable option than hiring a Solicitor or Barrister, especially since legal aid may not be available
Authorisation: You must ask the court for consent for a McKenzie friend to assist you. The other side can object, and the court must have a good reason to refuse.
Not a Solicitor: They do not need to be a legal professional and can be anyone you trust, though this also means they are not regulated like lawyers are.
